Rekayasa Jenis Kelamin dan Seleksi Genetik Mikroskopik pada Embrio Manusia: Telaah Filsafat Hukum atas Martabat Manusia, Otonomi Generasi Mendatang, dan Legitimasi Norma Hukum Indonesia

Kemajuan teknologi reproduksi berbantu telah bergeser dari upaya mengatasi infertilitas menuju kemampuan menyeleksi dan merekayasa karakteristik genetik keturunan, mulai dari pemisahan spermatozoa secara mikroskopik dan sitometrik, uji genetik praimplantasi, hingga penyuntingan genom lini nutfah berbasis CRISPR-Cas9. Hukum positif Indonesia merespons perkembangan tersebut melalui Pasal 58 Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, Peraturan Pemerintah Nomor 28 Tahun 2024, dan Peraturan Menteri Kesehatan Nomor 2 Tahun 2025 yang melarang reproduksi berbantu untuk tujuan memilih jenis kelamin anak, kecuali untuk menghindari penyakit genetik yang terpaut jenis kelamin. Persoalannya, larangan beserta pengecualiannya itu dirumuskan secara teknokratis-administratif tanpa artikulasi fondasi filosofis yang eksplisit, sehingga rentan kehilangan daya legitimasi ketika berhadapan dengan akselerasi teknologi dan tekanan pasar reproduksi. Artikel ini bertujuan menelaah secara konseptual, reflektif, dan kritis kedudukan ontologis embrio manusia, batas instrumentalisasi manusia menurut prinsip martabat, serta legitimasi filosofis pembatasan hukum atas rekayasa genetik reproduktif. Kajian dibangun di atas imperatif kategoris Kant, kritik Habermas terhadap eugenika liberal, argumen keterberian (giftedness) Sandel, prinsip tanggung jawab Jonas, teori keadilan Rawls, serta ide hukum Radbruch, yang kemudian dipertemukan dengan Pancasila sebagai staatsfundamentalnorm. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan filosofis, konseptual, perundang-undangan, dan perbandingan hukum. Sesuai ketentuan penugasan, penulisan artikel ini dibatasi sampai dengan bagian metode penelitian.
